I'm working on an eviction for a client. I went through the entire process and got an Order of Restitution from the Court ordering the tenants to vacate the property. I sent the Constable out to conduct the lockout and remove the tenants. The tenant resisted and the constable called the local PD for backup. The local PD has been trained to say the following words whenever they can: "This is a civil matter. We can't get involved."
So, the Constable contacted the Sheriff who basically says, "That's your job." This despite the fact that the statute authorizes both the Sheriff and the Constable to remove people based on Orders of Restitution.
I call the Sheriff's department and get the same story. "That's the Constable's job. They get paid for it we don't." Of course, I'm thinking, "Uh. What about the tax dollars?"
Then I hear from the Constable that the only way the Sheriff will get involved is if we start the entire process over and have the Sheriff's department serve every paper from the beginning.
There are even more details and they're even more frustrating. But I'm too peeved to put it in a post.
