True, market specific. In the bay area, the buyer loses in his scenario.
5 offers received today on a 3/1 townhouse I put on the market on Sunday. Asking $430k for 1100' and I'm in the suburbs. Best offer was $40k over asking, the rest were a minimum or $20k over. If the $470k offeror can't get his appraisal to come in, it's certainly not the seller's problem. NEXT!

In this particular case, the buyer wrote to the offer specifically with no appraisal contingency. If the appraisal doesn't come in they've already agreed to bring in the difference in cash. So, in this case, the appraiser has absolutely no bearing on the market value. The buyers are determining that, and the buyers know the appraisers may cause them problems.
