"Hired a guy to do some work...he did a terrible job. Do I still have to pay him?"

Instead...you seem to allude to the fact that it is okay not to pay him because he has crossed the border illegally...committed a couple crimes (not against you) (and this claim seems dubious anyway), was deported, and crossed the border illegally again. Assuming these facts are all true...none of them would eradicate your obligation to pay him for work he has performed. They are irrelevant to what you owe him. When you include them in your story it appears, to me and everyone else, that you are trying to avoid paying him based on these facts, instead of what is relevant.

If you hired him to do a job, and he didn't do the job, or didn't do it well, then you have a better argument to withhold payment. And yes...I am a lawyer...kind of.
