Calling all Lawyers...Need help with HOA legal question.
Ok, I'm in a suit with the HOA. The CCR's say: "No dwelling shall be permitted on any Lot at a cost less than $750,000, exclusive of the lot..."

That is the only statement pertaining to lot costs. There is no enforcement mechanism, no method of proof defined, no process of verification.

QUESTION: There is a term in statutory interpretation when a law has no enforcement mechanism, therefore is basically unenforceable. Is the legal term that I should use "the CCR's have no executory clause?" What's the clause that give's the body the right or power or authority to execute a rule?
