Need to see the HOA docs to offer an opinion.
But keep in mind that an HOA declaration is not a contract and its not a statute. It's a burden on land rights. Think of it like an easement, where one party has right right to use another's property for certain purposes. Easements don't generally have "enforcement" provisions in the same way that a contract or statute does. However, if an easement is being violated, a party can certainly sue to stop the violation.
