If a landlord refuses my right to let someone else assume my lease, and charges me a penalty for breaking my lease early, are they required to keep the apartment vacant for the time that my fee covers? (in this case 2 months). In other words, if I pay that 2 month fee, and then find out that they re-leased it to a new tenant during that 2 month period, considering they refused my right to find a new tenant myself, would I have a case against them?
