It'll all turn on whether the employees had a reasonable expectation of privacy when using whatever they were using to chat privately. If it's a work related account (what kind of app was used for this "chat"?) they likely have no reasonable expectation of privacy. Anyway, that's what the lawyers will be arguing about.
