I agree they aren't responsible for quality of construction, but that isn't the
issue. The construction quality appears sound.

If the city will be held partially responsible. They agreed it that it was structurally safe to build there based on soil and permits.

Now, there is something to be said about the intelligence of building on this side of a cliff. Probably dumb move on the buyers part, but the buyer can claim that he never would have built/invested if the city hadn't given the OK.
