I think there's a spectrum
There are pushovers, people who are appropriately assertive, and jerks. Shoot for the middle one.

If you aren't seeing results from talking to the person directly, I don't think it's a problem to go above them in situations where it's critical to get something accomplished. But the key is not getting those steps out of order. You have to give them a chance to fix it before you get a manager involved.
