I agreed until you said "and otherwise looking at your phone". That is a hunormous (as my 5yo would say) brush to paint
with. Where do you draw the line? What if the phone is mounted? Is GPS okay? Don't touch it? What about touching the radio? At what point do you think it should be made illegal? Should we ban all phones in out in the open in cars? What about the in-built GPS/entertainment system? Disable all the buttons unless at a stop light?

I don't disagree about the texting. I've been behind or in front of enough knuckleheads who are swerving, slowing, etc and they are clearly head down texting at 60mph with both hands. It's scary. But some of us have a phone in our car that is mounted and we are using it for GPS or music and I disagree that that is anywhere near as dangerous as DUI. It's just a such a huge range.
