There should certainly be jail time. The problem as you identified it
Is they are impaired. And it is not a crime to be impaired. In fact it is celebrated in many communities and cultures in our country. Especially on college campuses. You cannot support or allow a culture of impairment then expect those impaired to act as if they aren’t impaired.
