LOL. You're not very clear on the 1st then.
You could certainly argue that there is compelling interest in the public health and safety as to why the right to assembly has been abridged in many cases related to the pandemic, but only a hammer would try to say that the orders telling people they can't assemble in groups of more than 10 or 20 don't abridge the right to assembly.
