Plaintiff attorneys know who fights. Also, shouldn't take $80k to get to sum. judgment. If there's no merit to the claim, you should prevail at sum. judgment and you'll be investing in other attorneys from taking on other meritless cases against your company.

Settlement. Insurance deductible is $25K, so they aren't being that magnanimous.

Problem is that these cases are generally filed in federal court. Federal Courts don't generally award fees that often.
