Should I sue the builder?
Bought a new house in Texas on Nov of 2021 and the house has had been good but didn’t have issues until it got super cold here At Christmas. The house wouldn’t heat up. My Dad and I went into the attic and tried to see what was up. Didn’t figure it out but saw that the unit would turn off and then turn back on a ton. Didn’t call a service guy out due to the extreme cost on the weekend/ Christmas. Didn’t call someone til today mainly because the weather warmed up.
Long story short I just got a job offer to move to Georgia where I grew up so we are selling our house. I got a guy to come out here to check it out to make sure everything was in working order.
The service guy came and showed me what the issue was. He then showed me a melted and deformed tape measure that was left in the unit when they installed it. Luckily our house didn’t catch on fire but I’m sure our heating and cooling bills were higher due to the builders negligence. As of now I don’t want to sue but I just asked that they pay for the service call. What do y’all think?
