a person is eligible for draft, etc, are created by the employers themselves (eg, NBA, NFL, MLB, etc) and not the US government? If an "NBA2" started up and was willing and able to pay kids directly out of high school, they could do that, and that would be their prerogative.

As it stands, current professional sports organizations CHOOSE not to do that for various reasons (for better or for worse).
