He'll probably be cited and released, not arrested. Then he'll pay a
fine + restitution to you. It's not like you'll be giving him a jail sentence (unless he was DUI or is on probation or something. And even if he was DUI, he won't be charged with that unless he was pulled over during the same driving episode).
