He knew he was dead anyway. The fighting he did that day was for the very lives
of the friends who stood by him. The jailor provided him with the pistol, and barricaded them in the upstairs room, not in the basement cell for their protection, because he knew the fight was coming to Joseph, not the other way around.
His actions that day succeeded in saving the lives of all members of his party except his own and his brother's. In my book, that makes him a hero.
