That's where you're wrong. The agreement doesn't say he can do whatever he wants
They agree to give him power as long as there is a fair and consistent process which is this case he obviously a partial arbitrator. The judge could then rule in favor of Brady. If a CBA is in place you still have to follow it.

Judge Doty from this week: "I'm not sure Roger Goodell understands there is a CBA."
