Right. But it puts the ball back in agent’s court with both buyer and seller
knowing the agent has no legitimate claim to that extra 3%. Realtors can give commission back to make a deal happen and it would be awkward for the realtor to decline here (assuming the offer was otherwise acceptable to the seller).
