They easily can if he's still in a force situation. Just tag him and then the
base.
The defense has a nearly guaranteed out in that situation. It is up to the batter to make sure they catch the ball by hustling his butt down to first. Then the defense can decide, if they'd like, which runner they want on first when it's all said and done.
But with the batter not running down to first he allowed the defense to record both outs.
