So, it will mostly depend on the lease language. Very good chance they are stretching the language though, whatever it may say, because that's what larger landlords tend to do. Unfortunately, there's probably not a lot of practical recourse if they are violating the applicable language, unless she wants to get out of the lease early (and the landlord will fight that and try to make it not worth the fight).
