I think the official law limits them to holding someone for 23 days without charging them but I don’t think that’s always followed. The prosecutorial system in Japan is built around pressuring people into pleading guilty to avoid trials.
SOFA will get you favorable treatment on lighter charges but on anything like this they’re likely to prosecute him much tougher as the media runs crazy with stories like this. The Japanese criminal justice system is stacked against foreigners.
