I will just add that you and your employer can’t just “decide” to make some of
your compensation 1099 instead of w-2. If you walk and quack like an employee, then you are an employee (regardless of what any agreement may say). If the IRS or a state Labor Division finds that you are a misclassified employee, it will suck worse for your employer, but there will be ramifications for you as well.
