So i was cited for unsafe lane travel and failure to turn on headlights.
The part that kills me it was a "citizens arrest". someone called in and thats all they have to go on. All i remember was going to change lanes and someone was in my blindspot and honked.
The officer suggested i fight it in court. Also i know my headlights were on because they cant be turned off completely (the rest of the lights were probably off. it wasnt dark). also, the call and traffic stop occurred before 30 minutes after sunset, which is when the law says they need to be turned on.
The prosecutor has been unyielding.. He won't drop the headlights charge despite evidence to the contrary (my vehicle owners manual states headlights remain on even if switch is in 'off' position.) His plea offers werent much better than paying the fines outright. also, i just received discovery where the call in was noted, and there is another call noted in the discovery from someone describing a driver in a green vehicle, mine is black.
The traffic stop occured in lindon, i was pulled over by lindon pd. orem pd issued the ticket. they detained me for nearly half an hour, brought out the K9, and were just being jerks before they let me go with the citation. i still have time to take the plea, but id like to get a better offer or follow through with the trial.
I just need some advice on how to defend myself and/or get the prosecutor to offer something better.
