in your contract there is a clause that details what you can do
if you feel the builder is in breach of contract. If you want to get their attention you will need to notify the builder and escrow agent in writing what the breach in contract is. According to the contract they have 45 days to rectify the situation or the contract is nullified and neither party is held responsible and you would get your deposit back. I think you were in Ca?? my contract was in Az so there might be some differences. The thing is that if you want the things fixed you have to take the chance of losing the house. You could also say that you will notify the registrar of contractors and have them evaluate whether the job is done satisfactorily. Otherwise, you can just pay to have the Granite redone... probably cost in the #3-4k range
