Yep. The problem is the regulation and the fact that you can't litigate
When an industry is governed through regulation from the executive branch (in this case, the Department of Transportation), you cannot take a company that wronged you to a regular court, because they are not governed through case law. Instead you have to rely on the judicial arm of whatever federal agency defines the regulation. The DOT has no power to intercede on your befalf. All you can do is file a complaint. After enough complaints are made, the DOT may slap a company on the wrist. What do you get for your troubles? Absolutely nothing.
