Question about employment law, boss is trying to make it so a girl that I work
With is going to have a very difficult time leaving if she decides to.

6 months ago he agreed and wanted her to attend a con-Ed class and the cost of $13k. She agrees to it and he mentions that she has to agree to stay employed there at least 5 years for him to pay for it.

1 month ago he changes the way we are paid (more based on a weird formula of base salary + commission). We aren't happy about it but will see how it works. She also is renting a home that he owns, but starting to feel a little to "tied" to him, she and her husband decide to find another house and move out.

She gave him move out notice 2 weeks ago. Today he drops a long agreement on her desk and says something like "I found this in an old stack of my papers...." Turns out it is a long agreement that she agrees to work there for 6 years, if she leaves early, she will owe money back on a pro-rated amount and 8% interest on top of that.

She never signed anything that he agreed to 6 months ago. I think he wants her to sign it now, as he is feeling uneasy about her status and our new pay plan.

How would this hold up? She never signed anything at the beginning. And even if it could be proven that they did "agree", her employment/pay status has changed based on him coming up with this new pay scale. The only reason she has wanted to maybe look around is that she doesn't like the new pay situation.

Anyone know if he has a leg to stand on? We are in California.
