If the act was premeditated, murder. If it just happens, manslaughter. I think..
If you plan to kill someone, then the charge is murder (not sure on the exact differences between the different degrees)
If there is no planning (car accident, sudden fight that gets out of hand, etc.) it is manslaughter.

I think that purposely transmitting a deadly STD such as HIV should be treated the same as attempted manslaughter.
