Perhaps the solution is to split the difference.
Instead of the damaged person getting nothing, or some astronomical amount, arrange it so they get something, but not enough to ruin the health care system.
It's like the speed limit. Sure, we'd all be safer if the speed limit were 20 MPH EVERYWHERE. On the other hand, no speed limit would be too dangerous. So, we find a place in the middle to draw a line.
