Here's their "logic" as I see it:
The son's interest in the property is a marital asset that should have been handled in the divorce case. If the divorce did not address this property, the wife still has a claim to the property since it was a marital asset. Her QCD did not eliminate her marital interest in the property. In other words, her marital interest in the property is separate from the record title to the property.
