What would your R&D budget look like if whatever you developed
was free for the taking by anyone once you launched the product?

I acknowledge that baseless lawsuits filed by NPE's are a problem.

It's also critical to remember that the patent term is 20 years from filing (usually enforceable over a period of about 17 years from issuance). In some technology areas, the product isn't even commercialized until there are only a few years left on the patent term, if any. For other technology areas, the life of the product has run it's course after 5-10 years from conception (and patent filing).

I'm obviously biased, but I do believe patents are clearly a net positive for human scientific progression.
