I'm not sure where I come down on this, but there's a recent push to provide a legal framework for mining on the moon (known as the Artemis Accords).

IMO, the ability of legally mine on the moon will trigger a second space race. Rare Earth minerals will be the initial target. Then moving on to building the ability stage missions from the moon for deep space (Mars and beyond).
