I think it's more about bureaucratic propensity to pick on the compliant.
These guys seem to like an easy target. My guess is if they think somebody might get litigious or throw it in their face in the press, they are less apt to go after them. And yes, there is probably plenty of P5 bias rolled into it as well. In short, they are cowards who don't do their job.
