Of course they do!

I think they ask the rancher who provides their beef to name all of their steers "Wagyu" - then they can say that they only use Wagyu beef. Problem solved!

Real wagyu is japanese and rated A1-A5. Most wagyu steak is fake american wagyu, even at the steakhouses.
