Little known secret
LDS church doesn’t “own” BYU in a strict legal sense. The official term is “sponsor” as in monetarily. And therefore they own the BoT spots.
Could BYU use ensign peak as their investor? Sure. But it’s not like the money goes to the church and then back to BYU.
