Non-compete on business sales are not the problem. Non-competes for "typical"
employees are the issue they are targeting. I can't stand the FTC for numerous reasons, but getting rid of non-competes as standard terms in employment agreements is a good thing even in my extremely conservative view. They cause so many problems for employees who can't really afford to address the issue through lawyers, and the clauses are rarely necessary to protect the business from an employee who goes down the street to work for someone else. I expect you can still include trade-secret and non-solicitation of former customer language in an agreement. I guess we'll see though.
