The runner isn’t protected though even standing on first base. He’s forced to run. Tag the runner standing on first and
he’s out, then touch the bag and the batter is out also.
The runner is screwed either way. No way out of it. He did exactly what he had to do in this situation because the batter didn’t run.
The double play happened because of the batter. Either way the defense is getting an out. The laziness of the batter allowed it to be two.
