(Car insurance question) wife was found at fault for a rear-ending 18 months ago
She thankfully was not hurt. The other vehicle mostly had damage to an old trailer hauling a bale of hay. We saw occupants get out and later drive away. Our SUV was totaled. Our insurance company settled with 1/2 occupants quite a while ago. 2nd occupant attorney switched firms so process was restarted. Apparently they just rejected the insurance company’s offer. I just got a voicemail from our insurance that they are going to file suit and we would be getting served. We have never been involved in this type of thing before. I was told in prior phone calls that none of the occupants required surgery or had any injury requiring hospitalization. They reassured me for the last year this would just go away and was routine jostling for more money.

What happens now? All the voicemail said (I called back but no response yet) was it would be transferrred to the litigation team and to call when we get served. Do these go to court? Does the insurance company just shrug their shoulders and offer your max? It seems so dumb to get to this point. I’ve never been sued before and this unsurprisingly sucks.
