Looks obvious, but the other side could argue that the
$5000 promotion is what is wrong and it was an $8,000 promotion. They could also claim that even with the $5000 promotion they negotiated a further discount to sign the final contract. Nothing is obvious when two parties sign a contract and differ on the terms. Obviously some proof of the promotion would help, but it is not dispositive.
