But if it's just incongruent management policies...not discriminatory.
We had a similar thing on my previous team. Boss's buddy does not get vaxxed for covid, so he will be terminated....but at the last minute the boss files an exemption on "religious grounds" and the anti-vaxxer gets to work full remote. The rest of us were forced to return to the office. Definitely rubbed some people the wrong way. But it was not discriminatory from a legal perspective.
