They key is they have to have proof that a party broke the law. Showing up
after an accident (not witnessing), unclear or lack of evidence or conflicting witness reports can result in no citations issued or citations for both parties. There are also minor fender benders that don’t require a police report so no traffic ticket is issued.

Obviously most accidents are the fault of one of the parties but there has to be clear evidence in order to write a ticket (most cases it is clear).

The point was that tickets are not always issued in an accident and there are many instances of this being the case.
