What's the difference in intent? Both of them are doing the exact same thing. One is luckier than the other.
The difference in outcome has nothing to do with actions or intent. Just luck.
Shouldn't all texters share the guilt of those who die from texting accidents? As such, shouldn't the punishment be harsher to get the point across?
