If he’s at fault the police report isn’t all that important. But it’s usually a good idea to get one if you plan on using insurance.

As BYUtka mentions below, you may not need insurance. Insurance can cause a lot of problems in the future. I say get

To answer your question you file a claim with your insurance only.
