I'd say you are jointly and severally culpable with the criminal
for that portion of risk to the child's death that could have been avoided by you running away (whatever percentage that is with a baseline that the risk to the kids life at the time that you could run is under 50%- greater than or equal to a 50% chance and you shoulder no blame). The criminal carries the rest of the blame himself.
