The key is balance. Here in Nevada, malpractice suits got so out of control that
the largest insurers pulled out of the state because they could not offer a policy at any price that made financial sense. (my father in law had just started in the legal department of one of these companies when it happened). We passed some common sense reforms and achieved a balance that works.

On the other side, there are a large number of Doctors who either don't care anymore or never cared and truly deserve to be sued into oblivion. Our regulatory bodies don't do a good enough job taking these guys out so malpractice suits serve as a check against them. I have personally seen a number of Doctors in these cases who truly frightened me because of their lack of concern for anyone at all.
