There are industry norms. If those mats are a norm in the industry, they should
be punished for not having them. It is a major screw up on their part. Contrary to what you seem to believe it is "wrong" to not do your job to a certain standard and when it causes someone harm you should pay. That is how lawyers think. No one has to protect against everything, they have to protect against what is foreseeable. You shouldn't assume you know how complicated areas of law work when you do not.
