This is a common misconception. Med-mal claims are extremely expensive for a
plaintiff's lawyer who is almost certainly paid only contingent to a settlement/judgment. To win, they would need show that a doctor's care was well outside the standard of care a patient should receive AND that the patient was permanently injured because of that.

To do that, the plaintiff's attorney needs to finds experts (most likely fellow doctors) who will testify, convincingly, that the care was outside of the norm. This goes well beyond throwing crap against the wall and hoping it sticks.
