Well, I’m not angry and I think it is fair to be frustrated
My most recent two issues are:

(1) he is asking us to consent to releasing the escrow funds even though all the conditions of the escrow agreement have not been met. He said, “the conditions of the escrow agreement have been met. Do you consent to releasing the funds?” I responded saying, “I thought completing the job was a condition of the escrow agreement.” He responded by saying, “respectfully, I don’t know if the work is completed or not.” So, he is not verifying. He is not asking for proof or documentation. I mean … isn’t that a basic expectation?!

(2) He recently said, “ The seller is literally emailing me 5 times a day and I'm starting to lose my patiencewith them. I have put a ton of extra time into this and just want to help get it resolved so we can all move on.” It felt like he was making his problem our problem which I didn’t appreciate. As a lawyer, I would have expected him to have enough foresight to understand that this could happen and I would have expected him to have a willingness to deal with it since he was advising us to go this route.

But, back to the beginning, he assured us we were well-protected. Well, if we are well-protected, then why the concern if the sellers want to litigate this? But if he is concerned about the seller’s litigating this, then I guess we aren’t well protected when he assured us we were. If we were not well protected, we certainly would not have closed and would be fine with facing the reality of finding another home.

I also think his first priority isn’t and was never us!!! I think it was always to those he works with on a consistent basis, those that are going to feed him referrals. So, I think he was pressured just to get the deal done and so I think his obligation to us was probably secondary to his personal self interests.

I also haven’t been impressed with how he communicates with us and others. At one point he accused the seller’s attorney of “threatening him.” Seemed like overkill to me but I chalked it up to lawyer-talk.
