I'm not sure how they'll be able to define that. My guess is that that will be players still "enrolled" at their old school who have entered the transfer portal, though it might be if a student-athlete openly comments that he is thinking of transferring. I suppose they could also prohibit new NIL deals for current players until after the new school year, after the period when athletes are currently trying to transfer.

From what I've read, both from this article and others, they are only trying to stop the promise of NIL deals if a player will come to their school (or to not leave, if they are thinking of transferring). I've seen nothing that suggests that they will stop any current NIL deals for current student athletes.
