If your serious, I would hire an arborist, they’re pretty inexpensive, to come
Out and meet with you and the neighbor. You may be able to put a root barrier on His side of the driveway and the arborist can explain more about the space and make recommendations and the risks.

You can also look at planting a tall evergreen bush/hedge/shrub in that might be more suited to the space. There are many that can grow quite tall if wanting to make a green screen and if you have a front yard, plant your tree there.

The pistache sounds appropriate but the space is tight. That’s why I think an arborist may support you and help
Convince the neighbor. Or tell you that you’re wrong.


I think a tall evergreen hedge/bush is more appropriate.
